Several observations after spending the afternoon in the Utah House Judiciary Committee hearings on 2 gun bills. Rep. Brian King and Rep. Patrice Arent are such a credit to their constituents and the Utah Democratic party. Both so smart and asked such relevant questions. Nineveh Dinha of Channel 13 is drop dead gorgeous. I had the pleasure of sitting next to Jean Welch Hill, who spoke eloquently on behalf of the Catholic Diocese of SLC on the need for reasonable gun control. I sure wish she was our Attorney General right now! The room was packed., complete with the guy with an assault rifle on his back, and the guy who was out of order so security came in and took him aside. I saw some of my favorite people and legislators, and it really is amazing to watch democracy in action.
Utah can be a very embarrassing place sometimes.
Since OneUtah enjoys an audience of the most vocal proponents of arming American to the teeth ( I call you Bubbas), it seems appropriate to provide this EXCELLENT legal, historical analysis of the Second Amendment for ongoing reference.
Cheat Sheet for Bubbas:
The word ‘militia’ appears 5 times in the constitution.
Nineteenth Century state courts construed “bear arms” as having a purely military function
If you are semi-conscious today, you probably think your Second Amendment rights all but require every citizen carry a grenade launcher to defend himself, family, property, dog and pretty much anyone who happens to be within range of his choice of ammunition. And you probably think the ‘right to bear arms’ was intended as an individual right and has always been interpreted as such.
AND, you would be wrong…DEAD WRONG.
The Gun Lobby’s interpretation of the Second Amendment is one of the greatest pieces of fraud, I repeat the word fraud, on the American People by special interest groups that I have ever seen in my lifetime. The real purpose of the Second Amendment was to ensure that state armies – the militia – would be maintained for the defense of the state. The very language of the Second Amendment refutes any argument that it was intended to guarantee every citizen an unfettered right to any kind of weapon he or she desires. – Chief Justice Warren Burger, “The Right to Bear Arms,” Parade Magazine, January 14, 1990
Ever notice self-proclaimed Second Amendment experts (Bubbas) VIRTUALLY IGNORE the word “MILITIA?” Of course you have. No self-respecting NRA member, nor the average, spineless gun toting coward would DARE read the actual text of the Second Amendment even if they could.
So, it is up to the rest of us to get real clear on the Original Intent of the Second Amendment. A slow, careful read of the the article (below) is sufficient to arm yourself to the gills to pound any gun freak into the ground.
“Six of the original 13 states, when ratifying the Constitution, proposed amendments which would become the Bill of Rights. Four of these six ratifying conventions – those of New York, Virginia, Rhode Island and North Carolina – proposed amendments whose language closely mirrored what would become the Second Amendment. But the debates at the ratifying conventions in these four states make it clear that the delegates wanted to guarantee the right of the states to have militias, despite the constitutional empowerment to the Congress to arm the militias.”
The NRA is the enabler of death-paranoid, delusional and as venomous as a scorpion. With the weak-kneed acquiescence of our politicians, the National Rifle Association has turned the Second Amendment of the Constitution into a cruel and deadly hoax. – Bill Moyers
The procession of funerals of innocent children under the casual gaze of the gun lobby and 2nd Amendment zealots, reminds us that our public spaces are no longer safe. This is the antithesis of freedom and civic life. Americans must rise up now against this terror and demand basic security for unarmed people.
Thoroughly debunked years ago, the gun lobby’s favorite research – a 1995 study by Gary Kleck and Marc Gertz that reported an astounding 2.5 million defense gun uses (DGU) each year in the United States. Yep, you read it right; 2.5 million DGUs PER YEAR!
The Kleck study claims that 2.5 million times per year, someone uses a gun to defend themselves. That’s more defensive gun uses than happened in WWII in Europe in 1944. The Kleck study is so flawed the only thing it measures is the wild imagination of gun owners.
As recently as this month, the NRA referenced Kleck’s deeply flawed and thoroughly refuted study AGAIN in their magazine, America’s 1st Freedom.
With the help of liars like Alan Korwin and others, the NRA continues to feed its readers demonstrable lies and distortions.
Here, for your reference, is a short list of the many peer reviewed, refereed, academic articles published that clearly refute Kleck’s astronomical claim.*
- “The gun debate’s new mythical number: How many defensive uses per year?” Journal of Police Analysis and Management, 1997
- “The myth of millions of annual self-defense gun use: A case study of survey overestimates of rare events” Chance – American Statistical Association, 1997
- “Defensive Gun Uses: New Evidence from a National Survey” Journal of Quantitative Criminology, 1998
- “The Relative Frequency of Offensive and Defensive Gun Uses: Results from a National Survey”, Violence and Victims, 2000
- “Myths about Defensive Gun Use and Permissive Gun Carry Laws” Berkeley Media Studies Group, 2000
- “Comparing the Incidence of Self-Defense Gun Use and Criminal Gun Use” Harvard Injury Control Research Center, 2009
The ultimate proof the Kleck claim is bullshit, is the fact that despite spending 35 million dollars/year to deceive the public and threaten politicians, in fourteen years since the study, the gun lobby has funded numerous FAILED attempts to repeat Kleck’s study.
*It should be noted that Gary Kleck has refused to defend his study ever since it was published.
Note to readers: OneUtah is a leading publisher of accurate, trustworthy, legal and scientific information about gun rights, guns, violence, gun violence and the psychology of CCP holders. Read more about guns and meet the gun lobby.
“We have to go to war against the people who enable the gun violence, the people who stop us from keeping guns out of the hands of mentally unstable people, of felons, and that means the NRA leadership.” – Jerry Nadler
Many NRA members favor sensible gun controls.
I can’t imagine any response other than profound grief.
Apparently the shooter – who is dead – was only 20 years. 18 children dead.
Let’s fucking talk about gun control.
Thanks Scalia. This is what happens when gun nuts are allowed out. The FACT is, this kind of thing happens everyday in America. What does NOT happen everyday is that someone’s life is saved as the result of individual hand gun ownership (Alan Korwin thinks it happens at least 547 times per day).
RAW STORY – Published: Saturday July 12, 2008
An Oklahoma church canceled plans for a gun giveaway Friday at its annual youth conference, a local news station reported.
The church’s youth pastor, Bob Ross, said the AR-15 semi-automatic assault rifle was a means of luring young people as far away as Canada, according to Oklahoma City’s KOCO Channel 5 News.
“I don’t want people thinking ‘My goodness, we’re putting a weapon in the hand of somebody that doesn’t respect it who are then going to go out and kill,’” said Ross. “That’s not at all what we’re trying to do.”
The gun giveaway is a part of the event’s shooting competition. A gun was given away at last year’s conference and this year, Windsor Hills Baptist used the giveaway in the marketing of the event on its Web site (see above picture).
The pastor said the cancellation of the giveaway was due to the instructor of the shooting competition — and a pastor of the church — having injured his foot and being unable to attend.
The cancellation occurred after coverage of the controversy by local news stations.
A day before this story broke, a 12-year-old John White was accidentally shot in the head and killed in Oklahoma County by a 14-year-old friend who had easy access to his grandfather’s loaded weapons, local news stations reported.
“We would still have John with us today if people had taken more care, if they had used gun locks or gun safes,” says Kim Proc, John White’s great aunt.
Proc says officials told them they confiscated at least seven loaded guns from the home where White was that day, all owned by the 14-year-old’s grandfather, Channel 52 KSBI-TV reported.
John White’s family is determined to make sure his death impacts the way guns are kept in homes by changing the law.
I say bribe, because Google represents that all paid rankings are disclosed. But what about de-rankings?
OneUtah has been de-ranked by Google.
On April 15, I posted “Guns Advocates Lie While People Die” after I heard Alan Korwin on C-Span claim “hundreds of thousands of lives are saved each year.”
Its the power of the permanent record. You see, already, if you Google “Alan Korwin” OneUtah comes up #2 on page two. By tomorrow, it will be on the main page, so people can see that:
…it was. No surprise. Google is the only SE I write a map for. I do no other search engine optimization.
The next morning, I sat down to blog about this little-appreciated sign that the “promise of The Internet”, as the great leveler, that it might foster a new kind of transparency with all manner of implications for truth, meritocracy, and democracy…a place so bare and open, you could SMELL integrity.
It was GONE! I searched the first ten Google pages over and over. OneUtah had been purged by Google AGAIN (see Firmage Impeachment papers)
I then checked Yahoo and MSN searchs, and OneUtah still ranks about the same as today.
Frankly, it freaked me out. I can see the NSA — this one anyway — getting Google to de-rank OneUtah for publishing the Nixon Impeachment Papers…but the GUN LOBBY?
Today a Google search for “alan korwin” returns OneUtah on page 7.
Today is the first time I’ve found is within the first ten pages since it was on page 1 on April 18. I refuse to search deeper.
Yahoo search on “alan korwin” (page 2, rank 4)
MSN Search for “alan korwin” (page 5)
As you know, we have been invaded by the paid gun lobby web trolls for calling Alan Korwin on the carpet for repeating AND further embellishing one of the gun lobby’s favorite lies on C-Span.
Most recently, troll Bob S has been challenging my use of the New England Journal of Medicine (NEJM) Kellerman Study which states:
In homes with guns, a member of the household is almost three times as likely to be the victim of a homicide compared to gun-free homes.
Like parrots squawking in unison the gun lobby trolls insist the study is “oft-refuted” and flawed. It isn’t flawed and NOBODY has questioned it, except admitted gun freaks.
I checked LexusNexus and found nothing refuting the Kellerman Study. One can be fairly sure if an NEJM published study is challenged and fails, heads roll and careers are destroyed. Today Kellerman maintains the highest level of credentials and respect in his field.
Wikipedia has a good synopsis of the gun-lobby/NRA attack.
Kellermann is well known for his research on the epidemiology of firearm related injuries and deaths, published over two decades in 50 peer-reviewed publications. In a 1995 interview, Kellermann saw firearm and other injuries not as random, unavoidable acts but as preventable public health priorities: “I grew up around guns. My dad taught me how to shoot when I was eleven or twelve years old. Firearms are fascinating pieces of equipment. I enjoy the sport of shooting, although I rarely shoot anymore. However, as a clinician, as someone who is committed to emergency medicine, it is equally evident to me that firearm violence is wreaking havoc on public health.”
In this polarized debate, Kellermann’s studies quantifying the risk of mortality associated with gun ownership attracted criticism from pro-gun organizations and individuals. A National Rifle Association of America web page contends that Dr Kellermann “severely understates defensive uses of guns,” and that his “conclusions provide anti-gunners propaganda.” Kellermann’s findings have been linked to the June, 1996 Republican-led decision of the U.S. House Appropriations Committee to strip US$2.6 million from the budget of the National Center for Injury Prevention and Control at the U.S. Centers for Disease Control – the exact amount previously set aside for NCIPC/CDC research into the causes and effects of firearm-related death and injury.
In one comment, troll Bob S made this desperate attempt to smear Kellerman.
Following the link conjures an image of a greasy, white, gun-crazed pervert tapping away on a computer on the community room of some Baptist church deep in the boonies outside Tuscaloosa, Alabama.
So just as the gun lobby punished Kellerman for doing his job, Alan Korwin must be held to account for malicious and deliberate deception of the public.
And Alan can thank Bob S, for inspiring yet another public thrashing from OneUtah, for the gun lobby folks on the permanent record
Despite claims to the contrary, Alan Korwin did make a public statement that is untrue (a lie), and given the opportunity to apologize or correct his statement, has chosen to defend this untruth.
On April 9th 2008, Alan Korwin appeared on C-Span. In that speech, in reference to gun ownership in America, Alan Korwin claimed “hundreds of thousands of lives are saved each year” [by the defensive use of guns]. His defense is a 1995 poll by Kleck.
But that poll never won peer review, and the 1997 National Institute of Justice Research Brief, “Guns in America: National Survey on Private Ownership and Use of Firearms” concludes, NSPOF (National Survey of Private Ownership of Firearms) based estimate of millions of DGUs each year greatly exaggerates the true number.
So Alan’s claim is not only laughable and absurd but also, demonstrably false and therefore irresponsible.
Just in the last 3 pages of this analysis (pg 9-12) finds the following phrases to describe the Kleck and Gertz poll:
“…surprising figure, estimates are far too high.”
“It does not make sense”
“…results are almost as absurd”
“If those percentages were close to accurate”
“That number also appears completely out of line”
“Evidence of bias in the DGU estimates is even stronger…”
“…many DGU reports are exaggerated or falsified..”
“…greatly exaggerates the true number…”
“…the DGU estimates are not informative…”
Please find below, the full excerpts from which the above phrases are taken for your convenience.
It is quite clear that integrity and honesty are not qualities that reside in the same personage as many gun-advocates, and most certainly, not ones possessed by Alan Korwin.
Alan Korwin certainly has the ability to verify the accuracy of his claims, as do his interlocutors, many of whom have come to his defense on this blog.
I repeat. THIS is the beauty of the Internet.
Page 11 Conclusion:
The NSPOF does not provide much evidence on whether consumers who buy guns for protection against crime get their money’s worth. The NSPOF based estimate of millions of DGUs each year greatly exaggerates the true number, as do other estimates based on similar surveys. Much debated is whether the widespread ownership of firearms deters crime or makes it more deadly—or perhaps both—but the DGU estimates are not informative in this regard.
